  • Security and traceability: The notarized will is kept by the notary, who registers the essential information in the Chambre des notaires' Register of Testamentary Dispositions. This ensures that it can be easily located, eliminating the risk of loss, ignorance or destruction.
  • Simplicity of execution: Upon your death, a notarial will does not need to be probated by a court of law, ensuring that your last wishes are carried out quickly and easily.
  • Professional legal advice: The notary is an expert in drafting contracts and acts as your legal advisor, ensuring that your will complies with your wishes and legal requirements.
  • Precision and personalization: Drawing up your will with a notary allows you to clearly choose your heirs, specify the assets they will receive and organize the distribution of your estate exactly as you wish.
  • Family and estate planning: A notarial will gives you the opportunity to name the liquidator of your estate, appoint a guardian for your minor children, and plan special provisions, such as deferred remittances or specific funeral instructions.
  • Your questions answered: Your notary is available to discuss any concerns or questions you may have regarding your will and estate planning.
  • Service procedure:
    • Virtual interview with a notary to assess your needs and obtain legal advice;
    • Prepare your will and send a draft to the person who will sign it;
    • Meeting for explanations and signing of the will in person or in the virtual presence of a notary;
    • Once signed, your notarial will is registered in the Register of Wills of the Chambre des notaires du Québec;
    • Transmission of a virtual copy.
  • The cost of using the electronic signature platform is included in the price.
  • The notary, after a thorough evaluation based on his expertise, reserves the right to refuse to sign the deed, and an administrative and opening fee of $100 + tx will be deducted from the amount reimbursed.
  • Depending on your needs, your notarial will can include the main clauses mentioned in the "Summary".

Notes

  • If you areunable to sign your will in person at the notary's office, you can sign remotely via videoconference. This virtual approach complies with the standards established by the Chambre des notaires du Québec. If you are far from the notary of your choice, you cansign directly by videoconference , especially in urgent situations where a delay could jeopardize your rights. This option is also available if physical, health or climatic constraints prevent you from traveling.
  • A period of 3 to 15 business days will be required for the preparation of your service request
