Description

Declaration of legal heirs
  • When a person dies without leaving a will or leaving an incomplete will, the legal heirs can establish the list of the deceased's heirs in a declaration of heirs attested by a notary as provided for in the Civil Code of Québec.
  • The declaration of heirs is used by stakeholders such as :
    • financial institutions
    • insurance companies;
    • or for assets or other claims.
  • Heirs can also appoint a liquidator to administer the estate.
  • The document you obtain will be in virtual form and a true copy (paper version) signed by the notary.
  • By his signature alone, the notary certifies that he has verified the identity, status and capacity of the signing heirs, and that the document reflects their expressed wishes.
  • You can also use our other service to declare legal heirs by notarial act.
Some institutions require that a declaration of heirship be drawn up by notarial act, although the Civil Code of Quebec authorizes a lawyer or notary to attest the authenticity of a document by signature alone. This attestation confirms that the identity, status and capacity of the parties have been verified, and that the document faithfully reflects their expressed wishes.
