Declaration of legal heirs
- When a person dies without leaving a will or leaving an incomplete will, the legal heirs can establish the list of the deceased's heirs in a declaration of heirs attested by a notary as provided for in the Civil Code of Québec.
- The declaration of heirs is used by stakeholders such as :
- financial institutions
- insurance companies;
- or for assets or other claims.
- Heirs can also appoint a liquidator to administer the estate.
- The document you obtain will be in virtual form and a true copy (paper version) signed by the notary.
- By his signature alone, the notary certifies that he has verified the identity, status and capacity of the signing heirs, and that the document reflects their expressed wishes.
