  • Thelayoff notice offered in this service is designed to be used when the employer wishes to suspend an employee's work and employment relationship, either temporarily for a period of less than six months, or permanently for a period of more than six months.
  • Based on our questionnaire, the employer can choose a layoff of more or less than six months, depending on his or her needs. It is important to note that the applicable rules differ for a layoff of less than six months versus one of more than six months.
  • For a layoff of less than six months, the employment relationship between employer and employee remains intact. In this case, the employer is not required to provide notice of termination or pay compensation.
  • In the case of a layoff of more than six months, the employment relationship ends permanently. The employer must then provide a notice of termination, and the notice period or the compensatory indemnity must be paid if the notice period is insufficient. This notice period or indemnity shall be calculated on the basis of the number of years of continuous service accumulated by the employee, unless a legal exception applies.
