  • This general power of attorney by notarial deed meets the needs of a majority of people wishing to foresee who will be able to act on their behalf.
  • Signing a general power of attorney gives your proxy all the necessary powers to act with your property just as you might do yourself. It therefore becomes very important to appoint a highly trusted person to look after your assets whether with simple or full administration.
  • The choice of agent lies exclusively with the person who wishes to be represented.
  • The agent's powers extend not only to what is expressed in the power of attorney, but also to anything that may be inferred from it.
  • Process of service :
    • Virtual interview with a notary to properly assess your needs and obtain legal advice;
    • Preparation of the general power of attorney and dispatch of a draft to the signatories;
    • Meeting for explanations and signing the deed in person or in the virtual presence of a notary;
    • Transmission of a copy, virtual or paper, depending on the option chosen.
  • The cost of using the electronic platform for signing is included in the price.
  • The notary, after a thorough evaluation based on his expertise, reserves the right to refuse the signing of the deed and administrative and opening fees of $150 + tx will be withheld from the amount refunded.
  • According to your needs, the power of attorney may contain the main clauses mentioned in the "Summary" tab.

Notes

  • If you are unable to sign a deed in person at the notary's office, remote signing via videoconferencing is possible. This virtual approach complies with the standards set by the Chambre des notaires du Québec. Here are your options :
    • Direct remote signing: Possible if you are far from the notary of your choice, especially in urgent situations where a delay could affect your rights. This option is also valid if physical, health or climatic constraints prevent you from traveling. 
    • Virtual power of attorney : You can authorize a proxy to sign the deed on your behalf with a power of attorney attested virtually by the notary. These methods guarantee the validity and legal security of your document.
  • 3 to 15 business days are required for the preparation of the power of attorney.
