Appointment of a liquidator
- It is possible to appoint a liquidator in the case of a succession without a will, or with a will if the testator has omitted to appoint a liquidator.
- The Civil Code of Québec gives the heirs the right to designate a liquidator to administer the estate.
- A majority of the heirs may designate the liquidator. This decision must be taken by a majority of the heirs present.
- However, these rules may vary depending on the wording of the will and the powers you wish to confer on the liquidator.
- In the absence of a liquidator, the heirs must act collectively to settle the estate, following the directives stipulated by law.
