Does a declaration of inheritance replace a real estate transfer declaration?

No.

The declaration of inheritance establishes the identity of the heirs and, where applicable, the executor of the estate. However, it does not replace the declaration of real estate transfer.

When a building is part of an estate and its ownership is transferred to the heirs or to a specific legatee, a declaration of real estate transfer is generally required in order to publish the transfer of ownership in the Quebec Land Register .
