What is emphyteusis?

For a certain time, a person that we call the emphyteuta takes an assignment of an immovable property on which he exercises all the rights of an owner. The assignment of the immovable property is conditional upon that the emphyteuta makes improvements to it such as constructions, developments or plantations that increase its value in a lasting manner.

During the term of the agreement, the emphyteuta collects all the fruits and revenues generated by the improvements that he made to the immovable property. At the end of the agreement, he is required to return the immovable property to the owner with all the improvements which he has made to it.
