Emphyteusis is established by means of a deed, notarized or not, by which the owner assigns the immovable property in emphyteusis to the person who will be the emphyteuta. In general, we provide in advance in this contract the nature of improvements that the emphyteuta is required to make to the immovable property as well as the minimum cost of their construction. This deed must be published in the land registry to be opposable against third parties.
