Two separate lots must at first be created in the cadastral plan: one for the volume surface to be the subject of the right of superficies and the other for the underlying land to constitute the subsoil. The subsoil owner then sells the lot to be the subject of superficies to the person who will be the superficiary, by notarial act or not. This act will have to be published in the land register to be opposable against third parties.
