What is a discharge?

A discharge is a document in which a hypothecary lender (also known as mortgage lender) acknowledges having been, partially or fully, repaid for the sums which he has lent to his debtor. The discharge signed by the lender will allow to publish a cancellation of the loan.

The mere repayment of the hypothecary debt (also known as mortgage debt), even when it is recognized by the hypothecary lender (also known as mortgage lender) in a statement of account, does not constitute legally a discharge and does not allow to publish a cancellation of this loan.
