What is a real estate transfer declaration?

The real estate transfer declaration is a notarized document published in the Quebec Land Registry when an owner of a property dies.

Its purpose is to make the transfer of ownership of the property from the deceased to his or her heirs official and enforceable against third parties. It does not constitute a sale and does not entail a voluntary transfer of ownership; it simply records that ownership is transferred as a result of death.
