When selling a movable/personal property, such as a boat, the seller must disclose to the buyer the claims and encumbrances affecting such movable/personal property, or which may likely affect the exercise of his ownership rights, such as mortgages and hypothecs. The seller is also required to report to the buyer all problems affecting the quality of the movable/personal property. If the seller fails to properly inform the buyer about the condition of the movable/personal property, he will put himself at risk of being sued by the buyer and forced to pay for the damage suffered by the buyer.
