Who pays the costs of arbitration or mediation?

Unless there is an agreement to the contrary, it is generally agreed that the costs of arbitration or mediation, such as professional fees of the arbitrator or mediator, will be shared equally between both parties.

The party who wishes to be represented by attorney will however have to assume his fees alone. Each party is also required to pay itself the costs incurred for producing its own evidence.
