Does the syndicate of co-owners have to meet certain requirements in order to exercise its powers in due form?

To ensure the proper operation of the co-ownership, the syndicate of co-owners must be registered with the Quebec enterprise registrar, in the same way as a business corporation. This registration must be updated annually. The syndicate by failing to register or make an annual update declaration is thus not in good standing under the Act Respecting the Legal Publicity of Enterprises .

The syndicate of co-owners must meet annually, but can also meet as required, like for the application for an order of compliance with the by-laws of the immovable if there is a failure to respect those ones by a co-owner when the breach causes a serious damage to the syndicate, a co-owner or another occupant. The syndicate's powers can extend to the eviction of a co-owner.
