This new legal person is created by the publication of the declaration of co-ownership. In the case of new condominiums, it is the developer who will appear in the deed creating the co-ownership. The declaration of co-ownership is thus be drafted and published even before the sale of the first unit.
The situation will be different for condominiums resulting from the transformation of a building already existing and occupied. In this case, the owners, who could already be undivided co-owners, will have to all appear in the declaration of co-ownership.
