Description

  • The Civil Code of Québec provides that a designated liquidator may refuse to assume his office, even if he has been appointed by will.
  • He or she may renounce or resign at any time, provided this does not compromise the settlement of the estate. However, if the person appointed is the sole heir, he/she cannot evade this responsibility.
  • As soon as the liquidator has interfered in the liquidation of the estate, regardless of the type of resignation subsequently envisaged, he or she must render an account of his or her management to the heirs for the period during which he or she exercised his or her functions.
  • The document will be signed in virtual form, and you will receive a true copy (paper version) signed by the notary.
  • By his signature alone, the notary certifies that he has verified the identity, status and capacity of the signing heirs, and that the document reflects their expressed wishes.
  • If required, you can use our other service to resign, renounce or refuse the office of liquidator before a notary.
