Subject to the restrictions on which he may have agreed by contract with the owner, the emphyteuta holds upon the immovable property all the prerogatives of an owner during the term of the emphyteusis: he can grant a hypothec (also known as mortgage) on his right of emphyteuta, lease it, sell it, bequeath it by Will or use it for example to establish a co-ownership. He collects all the fruits and revenues generated by the improvements that he made to the immovable property.
The emphyteuta is also required to assume alone all the expenses relative to the immovable property: whether it is the construction cost of improvements or the cost of their repair, the repayment of a hypothecary loan (also known as mortgage loan), the payment of property taxes or insurance premiums.
