The subsoil owner acquires the constructions by paying its value to the superficiary. However, if the value of these constructions is equal to or greater than the one of the subsoil, the superficiary has the option to purchase the subsoil by paying its value to the subsoil owner, unless he prefers to remove the constructions and restore the immovable property to its former condition.
In case of disagreement on the value of one or the other of the two immovable properties, the parties can apply to the court so that the latter determines the terms of the sale.
