What if the appointed mandatary can no longer be in office?

Usually, a protection mandate provides a replacement for a mandataru. If the mandatary is unable or unwilling to act, a substitute mandatary, if the latter accepts his office, will take place without further formality other than a simple resignation letter from the resigning mandatary. If there is no substitute mandatary or no appointed substitute mandatary accepts his office, it will be the responsibility of the resigning mandatary to apply for the institution of protective supervision for the incapacitated person.
