What happens in the case of a professional subject to the control of a professional order who has accounts on the Web and who dies or becomes incapacitated?

Many professionals are subject to the control of their professional order just as they are very often subject to an obligation of confidentiality towards their clients.

In case of death, it would be greatly preferable that all the confidential data of the deceased professional are destroyed, unless they are transmitted to the professional who will take over his professional files or to an authorized representative of his professional order.

If the deceased professional was working for an employer, all the data of this one, even confidential, appearing in the email accounts of this employer, belong to the latter; in this case, we recommend to the professional not to use his employer's email accounts for personal use.

It is strongly recommended to these professionals, particularly to those who are self-employed, to use as little as possible the social networks, nor to use certain email accounts more problematic than others as for the access to the contents of an account in case of death and that, to preserve the confidentiality of exchanges and communications with their clients, especially if these professionals planned nothing, during their lifetime or when they were able of doing so, as for the fate reserved for the information and contents that they have in their various accounts.
