What are the situations in which the creation of a testamentary trust would be appropriate?

Here are the main reasons for which some testators choose to create a testamentary trust:

  • Bequeath money to minor children or grandchildren;
  • Giving a spouse a peace of mind as to the management of his/her inheritance;
  • Ensure sufficient income to the surviving spouse until his/her death, and stipulate that the capital of the testator's estate will thereafter be passed on to their children or grandchildren;
  • Make an important bequest in favour of an incapacitated person or avoid that an heir squanders his/her inheritance;
  • Reducing the tax burden for heirs.
