Where and how should the rent be paid?

The rent must be paid in accordance with the terms and conditions set out in the commercial lease.

The lease should specify, in particular:

  • the amount of rent payable;
  • the date on which payment must be made;
  • the frequency of payments;
  • the location or account to which the payment should be sent;
  • the payment methods accepted by the locateur;
  • the terms and conditions applicable to additional charges and other sums payable.

The parties may agree that payment will be made by check, electronic transfer, bank transfer or according to another method provided for in the lease.

The Civil Code of Québec stipulates that payment is to be made at the place expressly or implicitly designated by the parties. If no such place is designated, payment is to be made at the debtor's domicile, which, in the case of rent payments, is the tenant's domicile.

It is therefore preferable for the lease to clearly specify the place and terms of payment in order to avoid disagreements regarding the payment of rent and other sums due.
