Can spouses opt out of the parental union patrimony provisions?

Yes, the spouses may decide, by mutual agreement, to withdraw from the application of the provisions of the parental union patrimony. To do so, they must formalize their withdrawal by notarial deed, under penalty of absolute nullity. The withdrawal takes effect on the date of the deed.

If the withdrawal is recorded within 90 days of the beginning of the union, the patrimony of parental union is deemed never to have been constituted.
