What protection offers the registration of a trademark?

Registration of a trade-mark provides the following benefits to its user:

  • the registered trademark is protected across Canada, regardless of where it is used;
  • the burden of proof will be less complex if a third party uses a trademark that is likely to create confusion with the registered mark in the minds of consumers;
  • registration is valid for 10 years and is renewable every 10 years;
  • trademark registration is presumed valid;
  • a registered trademark increases its economic value (it is exclusive);
  • registration can have a deterrent effect on certain third parties who might consider launching a brand or name on the market that is likely to create confusion in the minds of consumers.
