Who is responsible for the expenses in undivided co-ownership?

In the absence of an indivision agreement, the cost of expenses will be shared equally between the undivided co-owners. It is strongly not recommended to proceed this way because an undivided co-owner who acquired his share at a higher cost than the others will see himself, in case of a fire or destruction of the premises, attributed the fraction of the expenses which he paid and not the real value of his share. As an example, if the owner of the right of use of the upper part of the immovable property pays the third (in the case where there are three undivided co-owners) of the expenses, he will receive one third of the compensation, although his housing unit has a greater value than the others.

Within the framework of an agreement, the undivided co-owners can decide that the contribution to expenses will correspond to the respective shares of each one of them or will determine contributions different from those of the shares.
