Who is entitled to a copy of the Will?

After the testator's death , upon presentation of proof of death, the following persons may request a certified copy of the will from the notary holding it:

• The estate liquidator ;
• An heir or a successor ;
• A specific legatee is entitled to an extract reproducing the parts of the will that concern him;
• Any person who, in the absence of testamentary provisions, would have been entitled to receive the inheritance.

To obtain this copy, the applicant must generally provide the notary with the following documents:

• A copy of the death certificate issued by the Director of Civil Status of Quebec ;
• Certificates of testamentary search issued by the Chambre des notaires du Québec and the Barreau du Québec ;
• Any other document or information required by the notary to establish the applicant's right to obtain a copy of the will.

The notary may also request information regarding the possible existence of a more recent holographic will or will made before witnesses.
