Yes, the case of co-ownerships by phases combines both types of co-ownership, horizontal and vertical. Each of the buildings (phases I, II, etc.) will be governed by a declaration of co-ownership called vertical. The land and common facilities to the different phases (swimming pool, tennis court, etc.) will be governed by a declaration of co-ownership called horizontal in which the different phases will be the private portions.
