Who has the choice of the notary at the time of acquiring a unit in a co-ownership?

In fact, if the purchaser pays the seller in full, this is including a payment made by means of an hypothecary loan (also known as mortgage loan), he will have the choice of the notary. This choice will usually be provided for in the offer to purchase and, failing that, the Notaries Act will confirm it. If, on the other hand, the seller is not paid in full, it is the latter who will have the choice of the notary. On some occasions, if you purchase a new unit, it is possible that the builder has a collaboration agreement with a notary who will be involved in the project since the beginning. The builder will probably suggest you to use the services of this notary.
