What is a warranty plan of the co-ownership for new or renovated buildings?

In Quebec, there are two types of warranty plan applying to the divided co-ownership for new or renovated buildings:

  • The first plan, mandatory, aims at new buildings comprising up to four superimposed private portions. For more details, click here;
  • The second plan, optional, aims at divided co-ownerships of more than four superimposed units and existing buildings having or not actually a residential vocation, and which will be transformed for residential purposes. For more details, click here.

Your contractor must give you a signed copy of the warranty contract appropriate to the new divided co-ownership ("condo"). You must respect the obligations provided in the contract only as from the moment when you are in possession of a copy of the duly signed contract.

This contract contains all the details of the protections offered by the warranty plan, the procedures for claims and the possible remedies in the event of a problem with your contractor. For more details, consult the website of the Régie du bâtiment du Québec.
