What property constitute the family patrimony?

The family patrimony is composed of the following property, of which one or the other of the married spouses or civil union spouses is the owner:

  • The residences of the family or the rights which confer the use of it;
  • The furniture which garnishes or decorates these residences and which serves for the use of the household;
  • The motor vehicles used for travels of the family;
  • The benefits accrued, during the marriage or civil union, under a retirement plan;
  • The registered earnings, during the marriage or civil union, in the name of each of the married spouses or civil union spouses in application of the Quebec Pension Plan Act or equivalent programs (except in the event of death).

Are excluded from the family patrimony:

  • The property received by one of the married spouses or civil union spouses, by succession or gift, before or during the marriage, or the reinvestment of this property.
