How do you determine the value of the compensatory allowance?
If the ex-spouses are unable to agree on an amount, the court sets the value of the benefit as the lesser of the value of the spouse's impoverishment attributable to his or her contribution, or the value of the other spouse's enrichment.
The court may also decide how the compensatory allowance is to be paid. It may order that payment be made in a single lump sum or in instalments, or that the award be settled by assigning rights to certain assets.
