Description

In collaboration with
  • The purpose of registering a movable hypothec is to make its existence known to third parties, thereby making it enforceable.
  • Registration of the moveable hypothec by the creditor will enable the latter to control the ranking of its security over time, subject to certain specific rules set out in the Civil Code of Québec.
  • The registration of a movable hypothec is valid for a period of 10 years from the signing of the hypothec. If it is to remain in force beyond that date, the creditor must renew the registration in the RDPRM to maintain its priority rank.
  • It is important to remember that a movable hypothec without delivery, even if duly signed, cannot be enforced against a third party unless it is registered.
