According to the current state of law in Quebec, the decision to quit its job for good is a right that belongs to the employee. The resignation of an employee must be clear, evident, voluntary and unambiguous. The resignation cannot be presumed unless the conduct of the employee is incompatible with a different interpretation. In case of doubt or ambiguity, the courts generally refuse to conclude to a resignation.
