If any compensatory indemnity is to be paid to an employee, it must be paid at the time of the employee's dismissal, layoff for more than six (6) months or termination; However, the law also allows to pay this compensation at the next regular salary payment. This compensation shall be equal to the salary that the employee would normally have earned between the date on which the notice of termination should have been delivered and the end of the employee's employment, but it does not take account of overtime.
