The law provides for exceptions for the delivery of a notice of termination or layoff for more than six (6) months to an employee. Employees excluded by law are:
- Those having completed less than 3 months of uninterrupted service
- Those who committed a serious fault or misconduct
- Those who have been permanently terminated or laid off due to an event of force majeure (e.g., fire)
- Those whose fixed-term contract has expired
- Those who have completed the specific task for which they were hired.
