Fraction of divided co-ownership

A fraction of a divided co-ownership includes a private portion and all the rights pertaining to that private portion in the common portions

The relative value of each fraction of divided co-ownership is determined proportionately to the value of all the fractions, depending on the nature, intended use, size and location of the private portion of each fraction, but without considering its use. 

The relative value of each fraction is stated in the declaration of co-ownership.

The private portion is the exclusive property of its owner. It consists of a housing unit, a parking unit and in some cases a percentage of rights in the common area

The common area is under the administration of the syndiate of co-owners. The common area includes the structure of the building, common areas (lobby, stairs, elevators, heating system, plumbing, etc.), the land field. The owners must also comply with the by-laws of the co-ownership relating to outdoor architectural uniformity of the condominium.
