Warranty of quality

The warranty of quality refers to the construction of a building and can also be called "warranty against latent defects." This warranty of quality only covers major defects that exist at the time of the sale and that are unknown to the buyer.

It is possible that an entire building or only some specific components of it, such as the swimming pool, spa, or wood stove, can be subject to an exclusion from the legal warranty of quality. The exclusion of such a warranty, whether in whole or in part, may have several consequences on the rights and obligations of each party. It will be important to take this into account when determining the sale price. In such a case, it is highly recommended that the buyer inspect the property while taking into account the exclusion of the warranty of quality.

It is important to remember that the professional seller cannot exclude his liability in respect of defects of which he was aware or could not have been unaware and which he did not disclose to the buyer.
