The warranty of ownership contains several components: the seller will warrant that the property is free of title defects and of all rights and claims, and that he would not be released from his legal obligation of warranty, except for rights and claims that he has declared at the time of the sale. In the case of an immovable/real estate property, the seller also warrants the buyer against any encroachment by a third party of which he is aware and any violation of public law restrictions that are not apparent and not registered.
