Family patrimony

In Quebec, the family patrimony is formed when there is a marriage or civil union. It includes the family residences and their furnitures, the motor vehicles used for family travel and the benefits accrued during the marriage under certain retirement plans. In the event of divorce or death, the value of this patrimony is partitioned. As for the pension funds, they are partitioned only in the event of a divorce.

All spouses who are married or civilly united since July 1st, 1989 are automatically subject to the rules governing the family patrimony. However, some spouses who are married since or before June 30th, 1989 may have waived their rights in the family patrimony by signing a notarial deed to that effect before January 1st, 1991.
