Title examination

The title examination is the process by which the notary verifies the titles of an immovable/real estate property, mortgages and other charges that may encumber such a property as well as servitudes that may affect it. The notary will consult the index of immovables for the property's lot in question and will examine all the deeds and acts registered against this property. The notary performs a title examination to ensure that the person claiming to be the owner of the property holds a good and valid title on said property and that there are no other persons who may claim such rights on the same property.

The notary will also be able to indicate to a lending institution which mortgage rank it is intended to require from the borrower. The notary will also determine the nature and location of servitudes affecting the property and which ones can reduce the enjoyment of the premises for a future buyer.
