A housing complex consists of several buildings in close proximity to each other and together comprising more than a dozen homes, if these buildings are administered jointly by the same person or by related persons within the meaning of the Taxation Act, and if some of them have in common an accessory, a dependency, or part of the framework, excluding a common wall.
The alienation of a building located in a housing complex cannot take place without the approval of the Régie du logement. The authorization of the Régie du logement is also required to confer a right to occupy, use, or other similar rights, unless it is for a lease agreement on a property located in a housing complex
Some alienations without authorization from the Régie du logement are however permitted: it is possible to alienate a housing complex by a single contract in favour of a single person; it is permitted to dispose of a vacant lot when it has no attachment or dependency in common with the other buildings in the housing complex and, finally, it is also possible to alienate a portion located in a building on which a declaration of co-ownership has been registered.
