Encroachment

Encroachment arises when an owner in good faith has built beyond the limits of his immovable property on an adjacent immovable property belonging to another owner.

If the encroachment is minor, the landowner who suffers the encroachment can ask his neighbor to buy the strip of land on which the encroachment is exerced or to compensate for the temporary usage loss.

If the encroachment is considerable, causing a serious prejudice or was made in bad faith, the landowner who suffers this encroachment can force the encroaching construction's owner to acquire his land and to pay him the value or force him to remove the constructions and restore the site to its former state.
