The attorney/mandatary or liquidator responsible for the simple administration of property:
- must perform all acts necessary for the preservation of the property or those that are useful to maintain the use for which the property is ordinarily intended;
- is required to collect the fruits and revenues of the property under his administration and to exercise the rights attached to the property;
- collects the claims under his administration and grants valid discharge for them;
- exercises the rights pertaining to the securities that he administers, such as voting rights, conversion or redemption;
- shall continue the use or operation of the property which produces fruits and revenues without changing its destination;
- is bound to invest the money he administers in accordance with the provisions of the Civil Code of Quebec relating to presumed sound investments;
- may, with the approval of the Court, alienate (sell) the property in return for payment or take a mortgage on it, where that is necessary for the payment of the debts, maintenance of the use for which the property is ordinarily destined, or the preservation of its value.
