If you have no protection mandate in case of incapacity, it is usually during a meeting constituted of the spouse and the family members that we shall choose a person responsible for representing you. Since there is no obligation in the Civil code of Quebec that the de facto spouse be convened to the meeting, it would be prudent to draft a protection mandate in case of incapacity so that you can choose the person who will represent you in the event of your incapacity.
