How a work is protected, in Canada and abroad?

A work or an object protected by a copyright will automatically receive the protection inherent to copyrights provided that at the time of the creation of this work, the author is:

  • a Canadian citizen or a person ordinarily residing in Canada;
  • a citizen, a subject or an ordinarily resident of a country which is a party to the Convention for the Protection of Literary and Artistic Works also known as the Berne Convention or any of its revised versions or to the Universal Copyright Convention, or of a country which is a member of the World Trade Organization; or else,
  • a citizen, a subject or a ordinarily resident of any country to which the Minister granted the benefits of copyrights by publishing a notice to that effect in The Canada Gazette.
