The co-emphyteusis is the way to submit to a divided co-ownership an immovable property held in emphyteusis when the improvements made by the emphyteuta to the immovable property are not susceptive to constitute an area of ownership distinct from the original immovable property: it is, for example, the renovation works made to an existing building. The co-emphyteusis is established by the publication in the land registry of a declaration called the declaration of co-emphyteusis.
