Why the spouse who is not the owner of the real estate property and who is married under a foreign matrimonial regime must intervene and sign the deed of sale?

The notary will also ask for the intervention of the non-owner spouse when the sellers are married under the authority of a foreign matrimonial regime. To avoid any ambiguity in the interpretation of a regime with which he is not familiar, the notary who receives the sale in Quebec will ask the non-owner spouse to affix his signature to the deed of sale and so to renounce in favor of the seller to the rights which he could hold in the real estate property. The spouses will settle between them the legal consequences of this transaction if there are any under their matrimonial regime.
