Of what consist the hypothecary remedies?

The hypothecary remedies (also known as mortgage remedies) are the remedies allowed to the hypothecary creditor by the Civil Code of Quebec when the debtor of the debt is in default under his deed of hypothec.

Let us remind here that each of the four hypothecary remedies provided by the Civil Code of Quebec has its peculiarities and that it answers specific situations which must be carefully analyzed by the creditor and his legal adviser depending upon the property hypothecated and the type of realization of security desired by the lender.

Notice, prior notice of exercise, time limits to be respected, publication in the appropriate register, drafting of the application, notification of the application, rendering of account, scheme of collocation, etc., in all cases of exercise of hypothecary right, it is indeed preferable to consult a professional of the law in order to well respect the mechanisms provided as much in the Civil Code
