What is the title examination?

Before proceeding to acquiring an immovable property, it is essential that a title examination is made by a notary.

The title examination consists in examining all the deeds of transfer of the immovable property which interests the prospective purchaser. The title examination will also be about to the charges which affect this immovable property. The title examination is made over a period which can vary from 30 years until the filing of the immovable property in the cadastre (thus over a period which may exceed a hundred years), the starting date of the search as from the expected date of the transaction. It is the mandate given to the notary that determines the scale of the search to which the latter will proceed.

This title examination will at first allow to confirm to the purchaser that the seller is the real owner of the immovable property offered.

This title examination will also allow to reveal the defects which can affect the titles of the immovable property concerned and, if necessary, the customer can decide, with the assistance of the notary, to correct or not the situation.
