Why create a trust by notarized contract?

It is preferable that the trust be established by a notarized contract signed by the settlor and the trustees. Although not mandatory, a notarized trust agreement allows to register some of its clauses in the RDPRM. This registration allows to easily identify the trust and retrieve the trust documents, which eliminates the risk of being lost, ignored or destroyed and, in some cases, it allows the trust to be enforceable against third parties.
